The Texas Property Code Sec. 34.04
(Claim for Excess Proceeds)
states that a person or business entity may file a petition in the court that ordered the seizure or sale setting forth a claim to the excess proceeds. At the hearing the court shall order that the proceeds be paid according to each former owner of the property, as the interest of each may appear, provided that the former owner (1) was a defendant in the judgment; (2) is related within the third degree by consanguinity or affinity to a former owner that was a defendant in the judgment; or (3) acquired their interest in the property by will or intestate succession from the former owner that was a defendant in the judgment. Consequently, your attorney will need to prove to the court that you and your family are the former owners or descendants of the former owners and calculate each owner’s percentage interest in the property.
